These terms govern your access to and use of Digitra Studio's website, design assets, and development services. By accessing our website or commissioning a project, you agree to these terms.
1. Acceptance of Terms
By accessing digitrastudio.online, browsing our case studies, or entering into a Statement of Work (SOW) with Digitra Studio ("Digitra", "we", "us", or "our"), you ("Client", "User") agree to be bound by these Terms of Service. If you do not agree, please discontinue using the website and our services.
2. Scope of Services
Digitra Studio provides bespoke digital creative services, including but not limited to:
- Full-stack Web Engineering (Next.js, React, Node.js, GSAP, WebGL).
- UI/UX Design, Design Systems, and Interactive Prototyping.
- AI Architecture, Intelligent Search & SaaS Product Development.
- Mobile Application Development (iOS, Android, React Native).
- Brand Identity, Motion Graphic Direction, and Digital Strategy.
Each client engagement is governed by a specific Project Proposal or Statement of Work defining deliverables, timelines, and payment stages.
3. Intellectual Property Rights
Client Ownership: Upon full and final settlement of all agreed project fees, all final design files, custom codebases, domain configurations, and deliverables created specifically for the Client transfer to the Client.
Studio Showcase Rights: Digitra Studio retains the non-exclusive right to display completed project screenshots, design mockups, and case studies in our digital portfolio, social channels, and promotional materials, unless an explicit Non-Disclosure Agreement (NDA) stipulates otherwise.
Pre-existing Assets: Open-source libraries, reusable boilerplates, and developer tooling remain licensed under their respective open-source licenses (e.g. MIT).
4. Payment & Milestones
- Project initiation requires an agreed advance deposit as outlined in the invoice.
- Subsequent payments correspond to milestone approvals (e.g., Design Sign-off, Core Development, Final QA & Deployment).
- Final production source code and hosting credentials are released upon receipt of the final milestone payment.
5. Client Obligations
To ensure rapid delivery, the Client agrees to provide necessary brand assets, API credentials, copy, and milestone feedback in a timely manner. Project delays resulting from delayed client approvals may adjust the estimated delivery schedule.
6. Warranties & Limitation of Liability
Digitra Studio warrants that all code produced is written to industry standards, passes modern security audits, and undergoes comprehensive cross-browser testing. We provide a complimentary post-launch support and bug-fix warranty window (typically 30–60 days based on plan).
Except for willful misconduct, Digitra Studio's total liability under any contract shall not exceed the total fees paid by the client under the applicable Statement of Work.
7. Governing Law & Jurisdiction
These Terms and any contractual agreements shall be governed and construed in accordance with the laws of India. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
